Job Sikhala has been acquitted of charges of plotting to overthrow a constitutionally elected government.
High Court Judge Justice Garainesu Mawadze presided over the case which saw Mr Sikhala walking out as a freeman.
Job Sikhala, who is the MDC National Vice Chairman and the Zengesa West MP was charged after he told a rally in Bikita, Masvingo province that the opposition party will hold a demonstration that will bring an end to Mmangagwa’s regime.
His exact words where, “We are a committed leadership that will give Zanu PF headaches and [Amos] Chibaya was not lying or joking about the war and fight we are going to take to the doorsteps of Emmerson Mnangagwa. We are going to overthrow him before 2023 that is not a joke”.
Sikhala’s lawyer, Beatrice Mtetwa filed an application for exception arguing that according to the constitution the accused’s utterances did not constitute a crime.
Justice MMawadze agreed with Mthethwa and reiterated that these charges do not constitute a crime since Sikhala is a political figure.
